Definitions

  • for "Legal notices": The terms and conditions.
  • for "Website" or "site": The www.hospivent.com homepage and the web pages contained within, or other collected information and/or applications managed or provided by Hospivent and accessed using computerised tools such as PCs, laptops,      handhelds, cell phones, digital cameras, television equipment, or other network devices for wired or wireless networks.
  • for "Content": Web pages, text documents, editorial content, communications, drawings, graphics, images and photographs, databases, software, and all other audiovisual material of any type and nature. for "Services": All functions, devices, applications, information, or other features available through this website.
  • for "Visitor" or "user": any person who accesses the website, with or without permission from Hospivent, or anyone who uses said site, whether or not they have "registered".
  • for "Framing": Inclusion of the "served" (linked) page belonging to a certain site within the structure of another "served" (linking) site.
  • for "Deep link": A direct link, contained on a website, to a specific page on another site that bypasses its homepage.

Procedures and conditions for using the website  

Anyone visiting this website or using it any manner accepts, without restrictions, to be bound by the conditions specified below. Anyone who does not accept these terms or does not intend to be bound by them should not consider to be authorised to access, use, or download material from this site.Hospivent reserves the right to update or modify these conditions and the procedures for accessing its website at any time without prior notice. In the event of changes to the conditions, accessing this website implies consent to respect the conditions as modified.


Applicable law  

All content published or provided on the website, including its selection and organization as well as the arrangement and design of the website, are protected by privacy law (Italian Legislative Decree 30/6/2003, #196), copyright law (Law 22/4/1941, #633, as amended by Italian Legislative Decree 29/12/1992 #518 on Legal protection of software), and by other national and international intellectual and industrial property law, along with any amendments and supplements.


Payment  

In the event of invoices remaining unpaid according to payment terms, all cost of collection up to a 30% fee will be the responsibility of the client.


Content and purpose of the site  

The content of the website has been examined with respect for Italian law and European Union directives, including those on the protection of literary and artistic works, and it is intended for national and international users. The purpose of the site is to publish news regarding the Hospivent, and the Group to which it belongs, on the internet for informative and advertising purposes, as well as to provide online services.Hospivent confirms that:

  • It implements procedures to ensure standards of accuracy, completeness, suitability, updating, and timeliness of the information on its website.
  • It commits to eliminating any technical or typographical errors that may occur as quickly as possible.
  • At all times, it reserves the right to alter its content and the functional and operational procedures of the website and the services it offers at its own discretion and without prior notice.
  • It cannot be held responsible for any inaccuracies, errors, or updating delays.

The content and all its elements may only be reproduced (including partially or citing the source) with advance written notice from Hospivent.


Regulations for using site content  

1. Authorized activitiesAccess to the website and its content, as a registered or unregistered visitor, is only allowed for the purposes permitted by Hospivent and as indicated on this website. The site and the data it contains may be consulted or utilized for personal use only (such as for personal information, research, or study).2. Prohibited activitiesThe user may not utilize or cause third parties to utilize the website and the data it contains for commercial purposes. Therefore, any economic utilization or commercial use by any user is strictly prohibited, unless contractually agreed in advance in writing with Hospivent. In all cases, the following are prohibited:

  • in general, any use that results in damage, interruption, or limitation of this website or its services, or has the potential to do so;
  • any unauthorized gathering of the personal information of third parties (e.g. e-mail addresses) through the website.

Prohibited activities – Consequences  

Without prejudice to any right, authority, or power belonging to third parties, Hospivent reserves the right to take legal action should any prohibited activities occur.  If violations of the website's conditions of use are detected, Hospivent reserves the right to take any corrective measures without prior notice, including preventing the visitor/user from accessing the website and its services and removing any material placed there by said visitor/user, without assuming any direct or indirect responsibility. Hospivent commits to collaborating fully with all competent authorities, including in order to promptly identify those responsible for any breach of the law.


Connections to other websites  

The Hospivent website may contain links to other websites belonging to third parties.By following links to other websites, users voluntarily leave the Hospivent site and are directed to pages on the web outside this website. Hospivent commits to requesting authorization in advance before linking to any third-party website. Users who decide to access other linked websites assume all risks that this decision entails. Hospivent is not responsible for the content of any websites that may be accessible through links that are not under the control of Hospivent. Without prejudice to agreements with third parties, Hospivent reserves the right to remove any link or linking program at any time.Any user who wishes to include a link to this website on their homepage must first request authorization from Hospivent by submitting their request in writing. Hospivent reserves the right to evaluate the request and grant authorization at its sole discretion; Hospivent further reserves the right to act pursuant to the law against any person who introduces links that have not been authorized in advance. Neither Hospivent (which for the purposes of this section should be understood to include its administrators, auditors, directors, employees, agents, and Hospivent consultants), nor any other Hospivent licensee may be held responsible for actions and/or damages that may be caused to the user and/or third parties from using this website and/or its content. Hospivent cannot be held liable for any actions and/or damage which may be caused by any steps it legitimately takes in order to address the aforementioned prohibited activities. Furthermore, Hospivent cannot be held liable for problems encountered by the user rising from interruptions, suspensions, delays, or malfunctions in providing the service resulting from the supply of electricity or telephone/telecommunication services, or other technical means by which the content is transmitted, and for which Hospivent is not responsible. Despite its consistent efforts to improve the services it offers, Hospivent cannot be held liable to third parties with regard to the accuracy or current status of the content of this website.

We have been supplying medical equipment, parts and accessories worldwide since 2009.  We have hundreds of customers spanning more than 30 countries.  


LISTING POLICY

Please note that customers will only get what is shown in the picture, if not otherwise stated in the description.  Please contact us first if there are any problems with an item.  We will be more than willing to help resolve any issues.  


GENERAL RETURN POLICY

Returns are accepted only if there is an error in the listing or the item is defective upon receipt (NOTE: Defective upon receipt does not apply to listings in which it has been stated that the item has not been tested or is sold as-is).  All defective items must be reported within 3 days upon receiving the item(s).  Items with specified warranties must be reported within the warranty timeframe.  All returned items MUST be returned in the same condition as they were received and in the ORIGINAL PACKAGING.  All returns require a Return Material Authorization (RMA) number. Customer Service reviews requests based on the following guidelines. The policy is subject to change based on manufacturer?s guidelines and requirements. Hospivent reserves the right to reject any return that does not meet the return policy guidelines.


CLIENT RESPONSIBILITIES

Please contact Customer Service. Returns of any type will not be accepted without an RMA number.

The Client is responsible for shipping charges on returned items and all risk of loss. HospiVent requires that all shipments have full insurance coverage and use a carrier that can provide proof of delivery. HospiVent will provide prepaid shipping labels or credit client?s one-way shipping charges for returns that are caused by HospiVent?s error.

If the original box is not suitable for shipping, the Client is responsible for repacking the product to avoid damage to the original packaging and the product itself. 

The Client should discuss the possibility of restocking fees being assessed with Customer Service.  Customer Service will be able to provide the amount and reason for the fee(s) on a case-by-case basis.

All approved RMA?s should be shipped to the address provided by the Customer Service team.  Clearly mark an adhesive shipping label with the RMA information and place it on the box.


THE ORIGINAL MANUFACTURER'S BOX MUST NOT BE WRITTEN UPON.  DO NOT PLACE SHIPPING LABELS OVER SERIAL NUMBERS.


PERMISSIBLE TIMEFRAME FOR RETURN

HospiVent provides a three (3) day notification window for our return policy.  All requests for an RMA must be made within three (3) days from the purchase date.  RMA numbers issued by HospiVent are valid for seven (14) days only.  The product must be returned to HospiVent within this timeframe.  RMA numbers will not be extended or reissued.  RMA product received with an expired RMA number may be refused or returned to the client at their expense and may be charged a $50 processing fee.


DEFECTIVE PRODUCT

Products which are not functioning according to the manufacturer's instructions may be defective.  Products inoperable or non-repairable under warranty will be considered for replacement or credit at HospiVent's discretion.


DAMAGED PRODUCT

If product arrives with damage that is visible or likely to have affected the contents of the boxes, the preferred method of handling it is to refuse delivery of the shipment due to damage by the carrier and notify Customer Service.  The carrier will be responsible for returning it to HospiVent.  The Client must note the reason for refusal on the carrier?s ?attempted delivery? record.  If the damaged shipment is accepted, the recipient must note all known and visible damage on the carrier?s ?delivery record? in order for HospiVent to file a damage claim.  The recipient must save the product and all packing it arrived in and notify Customer Service immediately so a carrier inspection and pickup can be arranged.  Failure to follow these instructions or to report damage within three (3) days from the invoice date will result in the request being denied as out of return eligibility.


NON-DEFECTIVE RETURNS

Non-defective returns are accepted for credit or exchange at HospiVent's discretion.  Specific manufacturers have more restrictive polices and do not accept open box returns.  Manufacturer policies are subject to change without notice.  All non-defective returns which are un-opened may be subject to a fifteen percent (15%) restock fee.  All non-defective returns which are opened are subject to a twenty-five percent (25%) restock fee. 


RETURNED PRODUCT RECEIVED MUST BE 100% COMPLETE.

All original manufacturer's protective packaging (including electrostatic protection), manuals, software, documentation, cables or other accessories originally shipped with the product, blank warranty cards, and original UPC codes on the box must be included in the return.  Incomplete returns may be returned to the Client or assessed an incomplete return fee of up to twenty-five percent (25%) in addition to any other fee(s).

Returns received with the original manufacturer?s box written upon or where the Client did not use an adhesive shipping label may be assessed a defaced carton fee of fifteen percent (15%) in addition to any other fee(s).

HospiVent reserves the right to charge an additional twenty-five percent (25%) restock fee for product approved for return as unopened but received in open condition.

SMALL DOLLAR RETURNS
